I used to work at a gas station and had to get my alcohol certification. In the last several years law enforcement has been using constant stings. Most stores now have a policy where everyone is carded. I had to enter birthdates in the register. A typical gas station will be hit by a sting 2-3 times a year for alcohol and tobacco.
Here is what I learned in State Alcohol Certification class:
If someone overserves a person, sells alcohol to an underage person or sells to a person that will likely give it to an underage person--YOU will lose your license for 6 months and lose your job and you will be fined by the State $5000. The store is required to stop selling alcohol products for 24 hours and the store is fined tens of thousands of dollars.

The consequences are very severe, so I was always told, when in doubt--don't sell. We carded EVERYONE for all tobacco and alcohol products. No ID no sale. Also if you arrive in a obvious group EVERYONE is carded. The last store I was at someone lost their job and all the penalties because a person who was 22 was buying alcohol and was carded, but they were with a 16 year-old with no ID.

The gas station near me two years ago was hit with a sting--and failed. Three people lost their jobs including the store manager and they lost a day's worth of alcohol sales. The worst part was 2 days later when I went to get a soda I heard some women crying to one of the employees wondering how she could get a job again and how she couldn't pay fines.

My friend (in his 30s), his girlfriend (in her 40s) and his Mom (in her 60s) went to Walgreens to buy some alcohol. My friend had a valid ID and was buying, but all 3 were carded. His girlfriend did not have ID--guess what no sale! I later told him why.

Advice: always buy alcohol alone, make sure your are sober and have a valid ID even if you are 75 years old.

Now you can understand why it is like this (not that I agree with these policies).

Didn't they tell you the strict laws in alcohol certification class. My former boss always backed me when I refused to sell to some angry (but not drunk) guy in his 50s. Our jobs were on the line!

Amen! The teacher of alcohol server class I took scared the s*** out of me talking about the liabilities, lawsuits and stings that alcohol servers face in NM. No way I'd back off requiring customers to show proper ID. I suggest contacting the NM Restaurant Association, who sponsors these classes - https://www.nmrestaurants.org/alcoho...ion-classroom/ - if you're looking for support and answers about any issues involved in serving/selling alcohol.

I was watching a youtube segment from a New Mexico news station and this guy got pulled over in Tucumcari for driving with O'Douls. He got convicted even though O'Douls is legally considered a non-alcoholic beverage because it has less than 0.5 percent ABV.He could not appeal because of the statute of limitations ran out.I think he was there for work and he had to leave town before he could appeal. Its now on his record.
