My landlord subletted her co-op apt to me without notifying the board and on a lease that is shorter term than allowed. I've moved in for only one week, and found the landlord irresponsible and threatening me all the time. I want to move out of this illegal situation now, but she refuses to return my $4000 deposit+first month rent (We did have a signed lease and I have receipts of the wire transfered payments). Can I take her to court based on the fact that our lease was illegal in the first place? And if I notify the board, would there be any negative credit/public record for me?
I would notify the board, saying that you thought they had given her permission. Ask their advice on what to do. Go to them as if you consider them the wise authority that you would like to be in good with. Play innocent. Maybe they will help you. I got a lease in a similar way.
