I haven't been getting continuous hot water since a couple months ago, but it's been getting pretty chilly and taking cold showers are getting a tad bit uncomfortable. However, I think my landlord will evict me soon after if I report to 311 that I don't get hot water, and I can't find any apartments in my area that cost as cheap as it does here. I need to stay in the area because I walk to school every day (about a 2 hour commute one-way) instead of taking the bus in order to make rent/bills.

Should I just put up with it for a few more months?

You can report online anonymously.

And a little friendly advice, you are paying for something that is not being provided…if you don't speak up for yourself who will. If you are worried to speak up about this what's gonna happen down the line, at school, your job, in your career, in your relationship? Your gonna get walked over all the time. Always speak up for yourself and do so with conviction.

on what basis will he evict you? not for calling 311. you mention walking so you can make the rent. are you current on the rent? have you ever been late? do you have a written lease? is something missing from the story?

There's only four tenants in the building and apparently I'm the only one who complained to the landlord because everyone else tells me they get hot water just fine. So the landlord will probably know it's me if I do report it.

I am current on the rent, but have been late numerous times. I have no lease. I can answer any questions regarding the story if you have any.

If the landlord tries to evict you for reporting a lack of hot water to 311, he will be in extremely deep doo-doo with the housing court. Just report it.

He says he can also evict me because I have 2 children and we're living in a 1 bedroom apartment. I have no idea if this is true or not, though.

I agree as long as you are up to date on rent--- I think reporting it will be a plus for you.... however I WOULD NOT BE LATE WITH RENT AGAIN.

if you have a written lease find out the governing board that governs the lease and then call to inquire about the 2 children/1 bedroom situation

you could even get a free consult from a real estate lawyer about that

If you have no lease then you're basically on a month-to-month arrangement. For which the landlord needs to give you a 30 days notice for you vacate the property. Anything less would be considered an "illegal eviction" and you need to call the police.

As others have said, he cannot evict you for complaining about not having hot water (this is true even if you're past due on your rent). Having two children in a 1 br is also not valid grounds for eviction.

What I get from your posts is that he's trying to intimidate you into keeping quiet about the hot water issue.
He probably knows that it will cost a pretty penny to get that fixed and being that you're not a stellar tenant (i.e. late payments) he wants you to though it out.
But like I said, you don't have to do that. You're entitled to heat and hot water despite how good (or bad) of a tenant you happen to be.


Btw, have you considered getting a bicycle for your commute, instead of walking 2 hrs each way?
