I'm renting out an illegal ground floor walk-in apartment. All rooms have windows (full size for living room & bedroom, small size for bathroom). Has sink & stove in kitchen and sink, toilet & stand up shower in bathroom. Consider habitable but C of O shows that it's a play/storage area and tenant knows about it. I want to give a 30 days notice to terminate the month to month tenancy (without lease), and take back the apartment for ourselves. I'm willing to pay a fine if I have to. Tenant is an illegal immigrant and is very difficult. What are the steps I need to take to get the tenant move out and should I get an attorney? Thanks.

Have you tried calling immigration?

No, we don't want to go that route. We're trying to reason with the tenant so they can move out willingly and in peace. But, based on the tenant's tone they're threatening that they will report us for renting out an illegal apartment. This is our first time encountering this situation. We're planning to give the tenant a 30 days notice to vacate in the coming week. Just want to find out what kind of procedures/steps we'll have to go through in order to take back the apartment for ourselves. Thanks.

If it is month to month, I do not believe you owe them a right to renewal, but you really ought to ask this to your lawyer.
