The rent stabilization laws have expired and if renewed who knows what the terms may be. You are better off just moving out. If she gave you till Sept. 1st to move out that is enough time. Save summer's rent and move out.
Try to fight this out in court and you may both be evicted.
This is the wrong advice. She has not been properly served. She's under no obligation to leave the apartment. If she plays her cards right, she could end up with a stabilized prime lease to the apartment, cutting the current prime tenant out of the picture.
But this WILL take a lawyer, and one with good experience in NYC/NYS housing law.

And I would add not just the law but this specific area, asserting legal rights.
It's actually quite common and many people have won rights, either to stay or be bought out.

OP, do not, under any circumstances move out of the apartment or hand over keys for any reason short of the Marshalls showing up with a court ordered eviction notice until you have spoken to an attorney. Once you vacate the unit it becomes much much harder to get back in. Possession is 9/10th of the law, as they say.

Going to court to have another case about housing and wasting people's precious hard earned tax dollars to deal with someone else's mess that could easily be rectified seems utterly ridiculous. Precious man hours and money on nonsense. Some people truly love to make a mountain out of a mull hill. When this happens, everyone suffers.

Kinda harsh words for someone living off affordable housing. Lets see you get kicked out of your place and have to pay market rate rent on the upper west side. I'm sure you wouldn't sit there and take being kicked out like a batch.
