I was watching a movie called "The MARATHON MAN" starring actor Dustin Hoffman and in the movie he owns a Colt Combat Commander .45 auto pistol

in one scene the police are at his apartment and they find the pistol in a drawer and they ask is this yours? and he says Yes and it's fully licensed and the papers are in the drawer.

the movie dates from 1976, did NYC allow handgun ownership with a special license? I heard only long guns are allowed in NYC.

NYC premise permits are relatively easy to get, but the whole concept of a premise permit is still unconstitutional.

a special permit to keep a handgun at home, yes that is still unconstitutional but since NYC is a very highly populated urban area, I can see why they have special permits for that

PREMISES LICENSE: IS A RESTRICTED TYPE OF LICENSE. It is issued for your RESIDENCE or BUSINESS. The Licensee may possess a handgun ONLY on the premises of the address indicated on the front of the license. Licensees may also transport their handguns and ammunition in SEPARATE LOCKED CONTAINERS, DIRECTLY to and from an authorized range, or hunting location. HANDGUNS MUST BE UNLOADED while being transported.

Really? It is "relatively easy" for a person without any criminal record to be granted a permit to keep, say, a handgun (a pistol) ONLY inside your home/apartment?


IN THE CASE OF A SINGLE-FAMILY DETACHED HOME: Say you have a single-family detached home with a yard all around it. Does confining the handgun "to your home only" mean that the handgun must stay only within the physical building(s) which constitute the home (the home building + any attached garage) but does not include the gun being taken on your person onto your front lawn or on your side lawn(s) or in your back yard? In other words, do the yards/lawns surrounding your home also constitute the definition of your home or do they not? And would it help if you install a high or high-enough fencing or gating surrounding the entire property to demarcate what is deemed to be your property (so that anyone coming onto said property over said fencing or gating without your invitation or permission can be deemed to be an intruder)?


IN THE CASE OF A SINGLE-FAMILY ATTACHED HOME: Say you have a single-family attached home with no yardage around it but perhaps just a bit of a backyard (such as with a brownstone or townhouse). Then I suppose the demarcation of your property is easily discernable as being the singular physical building itself? Or does it include that backyard as well?


AS TO AN APARTMENT IN A MULTI-LEVEL TRADITIONAL APARTMENT BUILDING OR IN A TOWNHOUSE/BROWNSTONE-LIKE BUILDING DIVIDED INTO WHATEVER NUMBER OF APARTMENTS: It would seem apparent to me that you should never remove the gun to be outside the front door of your home? So if you walk into the hallway to the incinerator or to the side or back yard of the building where the building's dumpster is located, are you not allowed to keep a handgun on your person during that trip?

courts have defined the residence as only the area you live . not common areas in a building not a detached garage , not outside the door of your living space . . .

Actually it is possible to apply for a concealed weapons permit in NYC. The problem is that it is very unlikely you'll get it.
