The text messages will only help the property owner, not the car owner. Let them show that as their "Proof" that would be the best thing!
The Judge would say "so you were warned multiple times to remove your car and you didn't. What do you want from me??"
Well, ok, but you said the car owner wouldn't have any proof, and in fact she does have proof. Maybe it won't help her in the end, but it's still proof.
Tow companies WILL tow on private property without a ticket. I am the president of my association board and we do it all the time. Our parking is private and the people on the city street we border can't seem to get it through their heads that we will enforce it. You're crazy for waiting months. I tow cars sometimes minutes after the owner parks them.
You might ask an attorney. You might want to put a notice in the paper stating your intent. I think it has to run a few days - or wait so many days. There are ways to cover your six if you think she may sue.

Hey Aieborneguy, do you have the contact of the tow company? I live in a condo, and a private parking spot comes with it. I tried to contact a towing company when an unauthorized vehicle park there, but I was told to contact my local precinct and have a traffic officer to issue a ticket first.
