Today I was stopped by an NYCT officer outside of the Queens Center Mall when I came off the Q53 SBS bus. I didn't have my paper ticket. This was no surprise to me, but it was the first time that I've received a summons. I plead my truthful case that my Unlimited Metro Card did not work at the machine where I tried it, but he didn't wanna hear it. I received a $50 ticket. To my understanding this is kind of a low fine, but I told him that I wanted to fight it anyway. He said that it wasn't worth it. I know that alot of you will also probably agree that it's not worth it, but I am curious as to how the process works. For me, it's kind of "the principle", and I don't have kids, a wife, a job, or other responsibilities so I don't mind taking a trip to an area in Brooklyn (that I've never been to before) to plead my case. I understand that it's my word against theirs.
My main question is this:
As long as I don't enter the court all belligerent, then things won't get worse for me, right? Meaning, at worst all I stand to lose will be the original $50 and a few hours, right? I won't receive an additional fine on top of the original one or recieve any type of other thing that would look negative on my record, right?
Thank You for your time.
P.S.- Feel free to ask for any further information.
No you wont get a worse fine by going to court and pleading your case. Best case they give you a discount. Worst case is lost time and a full fine of $50
I think there is a way for you to fight your summons by mail. You send in a statement telling your side of story, and provide any supporting documents, including but not limited to a copy of your metrocard with the serial !njmber.
i once took the bus to lga after taking the train
i didn't know you were supposed to swip your card in the machine outside to get a ticket for a tranfer
the transit cops happened to come on the bus to check tickets
i told them i had paid for the train
the guy took my metro card inserted in the fare box saw it gave me a transfer and told me not to do it again
the should have swiped you metro card to see if it was unlimited and let you go
