I have looked at a property in the poconos, a gated community with my real estate agent in May, I liked it but the price was just a little high.

I was looking around online today and noticed the same place on a forsalebyowner website! The price has been reduced 20,000, and it now includes incentives to buy including a plasma tv, that before when asked, I was told no its not included..so my question is:

Can I go see this place again alone and meet the owner and technically buy it without any repurcussions with the agent whom I am no longer using? I am only worried b/c not quite sure of the laws, but I signed a buyers broker clause at the stage of contract I put on another house but obviously that house fell through and so I am back into looking once again, and saw the house online now FSBO not with a real estate agent.

Can anyone answer this?

Seems to me the owner is doing wrong !!! I would call the owner and let the owner
and real estate agent fight it out. And, the way the market is today, the r.e. agent
will 'fight it out' But, again seems the owner is wrong. I can't see how you can
advertise with a r.e. company and fsbo !!!!! Interesting !!!

My husband and I looked at a house in PA also that was listed with an agent and FSBO. Apparently in PA, you can do both. I believe the seller has an agreement with the agent that if they bring you a buyer, you pay the commission if you sell on your own, you don't need to pay the commission.

I could also be that the contract that the seller had with the agent expired ... is this house still listed with the agent?

If your home does not sell with a particular agency within a certain time period you have the right to either switch agencies or to try and sell on your own.

I do not think that there is a law the prohibits one from looking at a home over and over ... in fact I do not think that anyone should buy a home on first glance ... they should look at it more than one time ... this is a big investment and where you are going to spend a good portion of your life ... you are obligated (to yourself and your family) to make sure that this is where you want to be.

Also ... now this is only my opinion ... if you know someone who is knowlegble ... say a contractor ... you should bring them on a walk through of this house ... just to make sure that it does not need extensive work ... just a thought.

I am not sure on this one. You may want to call the Pike Wayne Realtor Association and ask them. There may be a certain time period. There was person in our old neighborhood who did this -he never sold his house either way and finally took it off the market. If you do it too soon, the realtor may have a claim and god knows things are dry here in NEPA.

If you signed a buyer's agreement for the agent to represent you, you'll have to be sure whether it was a one-time agreement (to look at one house only) or if there's an expiration date on it.

We had signed a buyer's agreement and looked at many houses with an agent. We finally bought a house privately and although we had never looked at it with the agent we signed with, we notified her and our lawyer and paid her the commission on it anyway. After all the time she spent with us and the contract we signed, we felt it was only fair that we compensate her for her time. Plus, we live in a small community and run into this agent and others in her company from time to time so we were especially wanting to do the right thing.

I know in NJ if a realtor had shown you the home, and you went back again months later.........and then bought it in a FSBO, or with another agent...the first agent who showed you the home was still entitled to his commission. There was a length of time that needed to go by before you could do a different deal. Back when, it was a year, if I am not mistaken.
So before making any deal, I'd contact a lawyer for sure.
