TCS 449 tax refund of only 100 dollars for filing a joint return with my gf this year. We have been together for almost three years and figured we would get more tax breaks if we filed a married joint return which technically we are considered common law married.. But I had no idea she had so much debt to her name. My return was expected to be $9,550 dollars and I got a whopping $100 bucks back. I called a 800 number and it said I had no debt but when gf called it claimed she had debt from schooling. She doesn't recall it being that much debt. Could this be a scam? It's only been two weeks since I e-filed my taxes.

Is there anyway I can amend my tax return and just file separately since we technically are not married anyway?

Is there anything I can do to keep me from giving my gf a free ride on clearing her debt? My gf doesn't work so I don't feel I should have to be responsible for her debt and much less all in one lump sum..

Who can I call to confirm this amount is actually true?

I mean 9,000 dollars worth of school debt.. She doesn't even have a degree for crying out loud!!

I got it. You are common law married until it does not work out in your favor, then you are not "technically married" if it does work out in your favor.

Why didn't you figure out your taxes both ways first before you decided how to submit it?

And what the heck is TCS449, anyway?

Are you trying to say the IRS garnished your return for delinquent college debt?

Why did you decide to financially link yourself with someone about whose financial status you knew nothing?

I bet you have co-signed car and house loans too.

I am sure he did. That is why they claimed to be common law married. He saw a windfall if they filed together and had no idea they would be coming after their return to pay for a debt.

I think this poor sucker actually figured his taxes both ways, and decided he could make out better by claiming he's married (even if only common law). And he was probably right, except he didn't know about his girlfriend's... er, I mean his wife's huge student loan debt. That's not something a simple calculation would show.

In a word, yes. TCS449 is the Treasury Dept garnishing wages or tax refunds to pay uncollected, past-due student loans.

Seriously, the OP is in a world of hurt now. By filing jointly, he has declared to the government that they are married. Her debt is now his. They will start garnishing wages and claiming tax refunds until the debt is paid off.
