My husband was being pulled over while we where dropping off are children at school we where already parked and the kids where already in the school. They said they tried to pull him over for child being in front seat but there was no child in front seat and they did not have no proof child was in front seat
Can they do that?

I there was no child in the front sit (or whatever the law dictates in AZ) while driving you should fight the ticket.

On the other hand if the officer is correct the court isn't going to take kindly if your husband is caught lying.

I was in the vechile with my husband I am the one that got off the car with the children while this happened

There is no front seat child law in Arizona. The law says all kids have to be restrained as appropriate - car seats for under 5 and small kids whether they are front/back or in the trunk. So assuming this is AZ you are getting a ticket for not having the kid properly restrained which the cops may have observed when you drove up.

I have a relative whose kid went through the front windshield in a relatively minor wreck. The poor thing is severely disabled and will be that way for as long as they live. Entirely preventable. The cops do these "patrols" at our school from time to time. It's a good idea.

I am a bit confused as your poll says "child without seat belt" but your post says he was pulled over for having the child in the front seat. Which is it or both? If the child was in the front seat without a seat belt on, I hope they ticketed you for endangerment. An unrestrained child meets airbag in an accident is a very bad situation.

As far as proof, it is going to be your and your husband's word against the Police Officer's.

Invest in dash cams. At least 2. Make sure one covers the interior. If you get ticketed, it's your word against the cops. Then you bring your evidence to court.

GIMME A BREAK . . .

This should be about a Child's Safety . . . NOT a "he said / she said" and what can I do to blame this ticket on someone else?

If the child was not seated properly then, as already posted . . .

PAY THE TICKET and LEARN YOUR LESSON.

I would say pay, because if it happened on school grounds parking lot, more than likely they have it on video, and also, on the police dash cam, also his body cam. Pay the fine.
