You report him to the attorney general, file at the magistrate, the limit is $10,000. You will not get the full amount of the contract, you will only get what the cost is for finishing the job. The attorney general can fine him for not having a registration number.

I already notified the ag. Even sent a PDF of his craigslist ad stating he was state registered. I'll look into filing with the magistrate here. How does the magistrate actually go about forcing payment from him if I win?

I don't know about that, we punish taxpayers by raising taxes to jail simple thieves and criminals, plus the victims are never compensated for their loss by the criminals. Maybe a few whacks to the knee with a bat will be more of a deterrent that jail or court.

Maybe I'm being thick, but is there not really any information about the process or the costs of doing this online? I am interested in filing at the magistrate, but if I have to pay to file, pay to have him served, and then pay for the sheriff to sale his assets if he has any, it might end up costing me more than what it's going to cost to just get the rest of the work done.

Second- is there some sort of criminal charge? My fiance left a check for a guy to cut our grass and he showed up, took the check, and didn't cut the grass. The police actually charged him with a crime. Can I file a criminal complaint with the cops in regards to this?

Your local magistrate's office will not give you any legal advice, but will most definitely give you the forms that you will need and a cost breakdown. It will not cost you anything to retrieve these forms. My suggestion would be to take this first step and get the forms. It has been awhile since I have needed to file suit before a magistrate, and my issue before him was a landlord/tenant dispute, but I believe that my filing costs were less than $100.

Years ago, my late mother filed suit against a contractor who was paid in full, but his shoddy work was not detected until weeks later and a major rain storm. She did her due diligence by having another contractor investigate the problem, document the inferior work, and then, present her with a bid to repair. She took this information before the magistrate and sued. She won her case (approximately $3500), but never saw a cent of the judgment. The contractor placed all company assets in his wife's name.

To my line of thinking, her biggest mistake was stopping short of doing those things necessary that would prevent him from doing this to someone else. She did not have the wide range of social media available to her that you now have. It would have cost her more to try to collect the judgment, but if she would have been willing to pay $50/year, she could have at least been able to put a blotch on his credit rating interminably. Oh yeah, that contractor, that cheated my mom, is still one of the bigger contractors in the Monroeville area.
