There are certainly laws that set up government insurance...Social security is an example medicare is another, as is the VA, as is unemployment insurance and the list goes on. Insurance is not exclusive private. Besides whether or not a government sets up something has little to do with whether it can regulate it. Do you want to argue that the government can't force cruise ships to buy and stock life jackets because the government has no life jacket factories. On top of that what definition of insurance are you using to claim it is done (exclusively?) in the private sector?
