Right wingers today are against giving suspects a fair trial before they kill them. They think that's being "tough" and "macho".

Remind me which part of the constitution gives the government the power to decide how you wear your facial hair

Typical Fed bungling of everything. The elder DC sniper was sentenced to death a year after he was caught, and something tells me the evidence is WAY more stacked against this ****er than it was against John Allen Muhammad.

@Filihok the same part that lets the military tell its soldiers to have no beards and no mustache that extends beyond the upper lip.

****ed if I know, but if you can find a successful petition against the military regulations that prohibit soldiers from growing beards let me know. This is happening under MILITARY court, he is still IN the military.

That's beside the point. Do you know his technical status? Is he still a member of the military? He may be very well subject to USMJ but not technically in the military at this point.

I have to admit I don't know, I'm not too familiar with court martial proceedings. I wanna say that you're still a member until you are discharged, and I don't think he's been discharged yet. For what it's worth, his Wikipedia page shows his service years as 1988-, implying he is still in service:
