then wouldn't the converse be necessary? You would have to have a place where non smokers could go.
There are plenty... here in California (nanny state central), it's actually harder to find a complex that DOES allow smoking! My complex had no regulations when I moved in two years ago, and since then they've banned smoking in all common areas. We can still smoke in our own units, but not at the pool, walkways, stairwells, etc. As a smoker myself I am okay with that, but if they banned it inside our units, I would move. For crying out loud, I pay $1575/mo for a one-bedroom apartment - if I want to smoke inside, I should be allowed! It's still a legal product, and I as an adult should be able to make that decision for myself.
FYI: When I say "inside our units," that includes balconies and patios - I don't smoke inside very often, usually just on my balcony.
Once something like this passes then they will outlaw BBQ, them after that you won't be able to cook with a gas stove, only electric; after all, it is for the children.
Already happening... they don't allow BBQ grills on our patios/balconies, but do provide a common BBQ in the shared courtyard.
That's semantics. You just define anywhere you happen to be as somewhere that needs protection, and effectively control peoples' behavior. There is no place or manner where it doesn't violate the rights of the innocents by your reasoning. If your next door neighbor is smoking and you smell it your posts indicate you want the right to ban him from smoking in his own house. You're taking the sort of reasoning used to stop people from disturbing the peace to ridiculously exaggerated levels.
