Fortunately, the Supreme Court of the United States doesn't agree with you. In the UNITED STATES, the people are the government. But are unable to pass laws that impede on the rights of others. Since fascism has nothing to do with sodomy, your reference to fascism is nonsensical. And since sodomy between consenting adults is a private matter between those adults, people trying to pass such laws are the ones trying to enforce an overreach of the government (that would be closer to fascism, by the way.)

Um, everyone cares. If a law is Unconstitutional, it's Unconstitutional. State laws that are Unconstitutional are unenforceable. Hence, the Attorney General for the STATE OF LOUISIANA declaring that this law is unenforceable. The sheriff isn't arresting people for a crime that can be prosecuted. The sheriff is using tax dollars to harass people. And in the South, that isn't right. Abuse of power is not a good thing. Not in the South, or anywhere in the United States.

That's the 10th amendment for you lefties out there.
The United States Supreme Court ruled in Lawrence v. Texas (2003) that any state law prohibiting consent adults from engaging in sexual conduct whether heterosexual or homosexual is unconstitutional.

The so-called Sodomy Laws were struck down in all 50 states.

Since I live in ARKANSAS, I can assure you that in the South, as everywhere else, that laws are followed, and sheriffs who think they are above the law find out otherwise.
