I just don't see how they can argue the 30 mile requirement.

Judge Edith Jones should be removed.

A three-judge panel of the 5th U.S. Circuit Court of Appeals in New Orleans

of the law's provisions. One requires doctors who perform abortions to have
admitting privileges within 30 miles of where the abortion is performed. The
other restricts how doctors administer abortion-inducing drugs.


5th Circuit Judge Edith Jones, however, questioned whether a drive of that length truly places an undue burden on women seeking an abortion.

Texas Solicitor General Jonathan Mitchell said the groups had no way of knowing how clinics would be affected by the law before it took effect. Jones and Haynes also cast doubt on the groups' forecast that the privileges requirement would force at least one-third of the state's abortion clinics to close, denying more than 20,000 women access to an abortion annually.

Should be interesting. Of course, if the court rules it Constitutional, the consensus here on CD will be "YAY! If not, the consensus will be "Activist judge!"

FYI. Just because a justice asks a question does not mean the justice holds that opinion. Sometimes justices ask questions so that the attorneys can state their reasoning for or against.

She didn't ask a question, she made a statement that a 150 mile drive is reasonable. A better question is why a 30 mile radius for admitting privileges for doctors is a reasonable request since a 150 mile drive is required to visit a clinic. This isn't the first time they had issues with Justice Roberts ordered a review back in June in an unrelated issue.
