You opine, I differ. SCOTUS will decide, and then the states will decide to submit to the fed or not. We live in interesting times.

The 14th amendment is a flawed amendment that is used to justify anchor babies and legislate acceptance of immorality. It was meant to guaranteed citizenship to former slaves and nothing more. Women felons can use it to exercise their right to keep and bear arms, but not male felons.

The 10th Amendment does not conflict with, nor is it repealed by the 14th Amendment.

Both are currently in effect and equally valid.

No, Harrier has passed basic civics classes and understands the U.S. Constitution.

His comment was directed toward civics and constitutional ignoramuses such as yourself, and his future career motive is to prevent students whom he teaches from voting with the same non-understanding of the constitution which you have abundantly demonstrated.

You will be welcome to sit in on Harrier's classes anytime(Harrier won't inform the principal and he will introduce you to the class as a student teacher).

Battle between state rights and the Federal Government. If the people of Kentucky wanted gay marriage then they would vote to allow it. Until then the Government is out of line.

What's the most alarming to me are the people who cheer this kind of action. Wether you want gay marriage or not, the way it's being forced on the people by corrupt judges and the Government is just downright wrong. It's only a matter of time before they do this with something that you DON'T want, you guys are giving WAY too much power to the wrong people...

You do? Then explain how you could previously argue that this action is unconstitutional when it clearly is not.

And the other poster is essentially correct. The 14th amendment does not trump the 10th amendment per se, but it is one of the amendments which provide the framework for which states may exercise their rights under the 10th amendment.

A whole bunch of federal judges (you know, people that actually have their JDs) have made similar rulings on this matter. The argument is essentially settled.

The people have no right to vote against other people's civil rights. We're not a direct democracy, so no the government is not out of line.

Unfortunately, the feds/judges have often had to drag states into equality.

Were you equally disturbed by forced school desegregation?


I posit the greater evil of discrimination and oppression far outweighs "activist judges."

That you would have more problem with "judicial activism" than ACTUAL oppression of people and denial of rights says a lot about you.
