It looks like this will end up in the conservative SCOTUS after all. The 6th Circuit court broke with every other ruling to decide it was OK to ban gay marriages in four states.
"I would have thought the best way to get respect and dignity is through the democratic process," Sutton, a George W. Bush nominee, said at the time. "Nothing happens as quickly as we'd like it."
You gotta love that. Put human rights up to a popular vote! Go democracy! U! S! A! U! S! A!
And there's the Circuit split. This pretty much corners the Supreme Court into deciding it once and for all (unless the 6th Circuit reconsiders en banc and reverses).
It takes either some serious gonads or some serious stupidity (or both) to look at the rulings of every other such case and simply decide you are right and they are not. Shameful and completely against precedent, but only a minor setback in the grand scheme of things.

What special rights are you talking about? If gay marriage is legalized then all Americans can partake in one. You will get this right as well. No special rights here.
True. Many people took the sign of SCOTUS not taking up the issue as a sign of where they stood. I always though it was because they didn't have split decisions from the lower courts that would necessitate them taking up the issue.

If the Supreme Court denies cert, then straight married people will continue to enjoy special rights in states that are allowed to (and do) ban gay marriage.
