If he had surgery, he should've been at home.

But it doesn't mean he couldn't have been out.

Man paralyzed after encounter with police. “The thing speaks for itself.” A doctrine under which it can be demonstrated that the injury was caused by means under the defendant’s exclusive control and would not have occurred in the absence of negligence.
