There is no other way to spin this, the Obama DOJ went to court, and refused to defend it's own federal agency, in a law suit brought by the NAACP, and League of Women Voters. The judge who presided over the case was shocked that the DOJ refused to offer any defense at all.
This morning, as I predicted would happen in an article on Sunday, the U.S. Justice Department took a dive and filed a pleading in which it not only failed to defend the actions of the EAC, but agreed with the plaintiffs and consented to both a TRO and a PI. Judge Leon called the pleading “unprecedented” and “extraordinary.” He said he had never seen such a document in his entire experience as a lawyer or a judge. He was obviously astonished that the Justice Department was not defending the agency, and it was soon clear he was not going to allow DOJ to just roll over.
Here's the short of it. Three states asked the EAC to amend the federal voter registration form to include positive proof od US citizenship, the EAC complied. After all, the US Constitution says only US citizens can vote in national elections.
Well, the Obama admin wants non US citizens and illegal aliens to vote, sothey got with leftist groups, said "hey, you guys sue the federal government to stop this citizen requiremtn on the EAC form, and we, the DOJ, will not oppose you at all."
The judge in this case tore the DOJ lawyers a new one, and allowed the states to defend their case, since the DOJ was refusing to defend the EAC. In fact, the DOJ told the EAC, they will not defend this case, and denied the EAC from appointing its own lawyers to defend itself.
Under federal law, the EAC is responsible for designing the federal voter-registration form required by the National Voter Registration Act, or Motor Voter, as it is commonly called. While states must register voters who use the federal form, states can ask the EAC to include instructions with the federal form about additional state registration requirements. The Obama admin does this all the time, they don't like a law or regulation, so they ask special interest group to file a bugus lawsuit, and then Obama instructs his admin agencies not to defend the law, and sides with the plantiff, so it becomes the new law of the land.
They did this with DOMA. Obama did not like DOMA, liberal group sues, and Obama refuses to defend the law, judge rules in favor of the plantiff.
The regularly do this over at the EPA. If Obama wishes Congress would pass a law demanding the EPA enforce some draconian regulation, but Congress refuses to do so. Obama has some environmental group to file some flimsy lawsuit to sue the EPA and force it to comply with Obama's wishes, the EPA refuses to defend their regulation, and the liberal judge rules in favor of the lunatic desires of the plantiff, and it's now included in the federal regulation.
Proof of US citizenship would be a passport, or passport card. With a penetration rate of under 50% that's automatically excluding a large portion of your voting base.
A copy of your birth certificate or naturalization form is also proof. You need to provide proof of citizenship to work in the federal government too.

A friend of mine works for CBP on the southern border. Every time they catch a guy lying about his US citizenship when they wave a US birth certificate around, they are asked where they got it.
Invariably the answer is I found it on the street. So if you need your birth certificate, go to Mexico, the streets are paved with them.
