Anyway, sometimes we'd see them run until out of sight. But often, Border Control would have a helicopter overhead, and the copter would LITERALLY herd them back into MX. It seemed as if there was an unspoken agreement between Border Control and the UDAs. As in: ok guys, we spotted you, you see us, so we'll just hover over you until we see you cross back into MX. Undoubtedly there was NO paperwork on these incidents. Undoubtedly the UDAs tried again another day.

For all you cons living in Bumfart, IN or similar areas far from the US MEX border, this is how things go.
Nobody cares what the border dwellers think, they don't make nor trump US law no matter how much you think you own the place.

This hardly sounds like what happened in this case and goes against what the alien and his attorney are saying. Indeed, the alien and his attorney state that he was physically removed (not herded like cattle by an overhead chopper) by DHS BP agents on 18 FEB. If this is the case, there should be some documentation to support this. Of course, there isn't, which makes me call into question the alien's story.

And according to the alien's own attorney:

Note, such line is different from the narrative that the alien voluntarily and expeditiously turned himself in after crossing the border as the civic-minded thing to do.

If the alien was, in fact, forced out of the USA on 18 FEB because he lacked DACA documentation, but then had a friend bring it to him the next day, which is when he crossed back into the USA, then he has a stronger legal case. But, as of now, its only his word vs. the word of DHS. I'm going with DHS on this one.

Also, anyone who was under DACA protection LOSES that protection if they voluntarily leave the country and attempt to re-enter illegally. That is what this guy did.

The Department of Homeland Security says a young man who was returned to Mexico was not part of a program that shields people from deportation, as an advocacy group claims in a lawsuit.

DHS said in a statement Tuesday that 23-year-old Juan Manuel Montes was taken into custody in February by the Border Patrol just minutes after illegally entering the U.S. by climbing over a fence in the California border town of Calexico. DHS says he acknowledged entering illegally.
