President Trump’s lawyers have for months quietly waged a campaign to keep the special counsel from trying to force him to answer questions in the investigation into whether he obstructed justice, asserting that he cannot be compelled to testify and arguing in a confidential letter that he could not possibly have committed obstruction because he has unfettered authority over all federal investigations.
...Trump could not possibly have committed obstruction in the Russia investigation because the Constitution empowers him to "terminate the inquiry, or even exercise his power to pardon if he so desired."

...a President can "order the termination" of a Justice Department or FBI investigation "at any time and for any reason."

At the March 5 session, according to one of the sources, Mueller made the case that only Trump himself can talk about what his intent was regarding certain actions he took after assuming the presidency, which remains the Mueller team's position.
"Every action that the president took was taken with full constitutional authority pursuant to Article II of the United States Constitution," the letter states. "As such, these actions cannot constitute obstruction, whether viewed separately or even as a totality."

The letter states the president "could, if he wished, terminate the inquiry, or even exercise his power to pardon if he so desired."
Mr. Trump’s lawyers fear that if he answers questions, either voluntarily or in front of a grand jury, he risks exposing himself to accusations of lying to investigators, a potential crime or impeachable offense.
pretty low confidence in him to tell the truth?

Mr. Trump’s broad interpretation of executive authority is novel and is likely to be tested if a court battle ensues over whether he could be ordered to answer questions.
I'd be interested to see where their legal agreement goes in a court case. Obviously, this is uncharted territory.
Who leaked the letter? First of all there is nothing wrong with the premise of the letter. Bill Clinton's lawyers sent a similar letter to Kens Star when Star was conducting bis own with hunt against Clinton. 2nd, doesn't ANYONE find it a little odd that someone in the FBI or perhaps Muller himself leaked this letter to the NY Times of all media outlets, yet he has leaked nothing about his investigation. This entire investigation is terribly disturbing.
Good point on the investigation, I'm not sure how it would help them to leak it.
He did the same thing in NYC. Leaked on himself. It is an old game with him. Not my theory as much as I lived in the NYC area for 30 years. His scam is old as the hills.
Mueller is actually working for Trump. Dems are going to be so pissed when this ends. lol
