The smartest thing to do would have been not to make these comments in the first place. Next-best would be to settle out of court. That's still a possibility, but so far, Musk looks like he's being Musk.
As a senior officer of a publicly traded company, he needs to be very careful about the accuracy of public statements that could materially affect his company's stock price. Providing false (inaccurate) information is illegal for very good reasons - even if it's done without corrupt intent, you're deceiving investors and unfairly enhancing or depressing the wealth of investors, and that's just the start of it. Musk seems to not know or to simply not care what the laws are in this regard. I think he's basically gotten a pass in large part up until now, but this shouldn't be allowed to continue. I admire the guy in many ways but that doesn't mean he should be able to get away with anything just because he's Elon Musk.
