This was not a legally authorized arrest. Garner told them they had no cause to harass them. Anyone arrested as many times as him likely knew his rights.
...In that state (NY), an arrest is “authorized” if the police have probable cause to believe that the suspect has broken the law, even if the suspect actually hasn’t...
I'm thinking you're giving Garner's legal acumen far too much credit, personally.

That had no probable cause. Standing on the sidewalk is not probable cause. I already noted, his legal acumen is irrelevant.
Eric Garner Death By NYPD Chokehold: Second Video Showing EMT’s Not Helping Man Raises More Questions [WATCH]
"The New York Post posted the video of Garner on the sidewalk lifeless as police, who had previously slammed him to the ground and put him in a chokehold, stood around. The 7-minute video shows several NYPD officers crouched around Garner, who is handcuffed and not moving. One officer suggested they should call an ambulance, but instead, the team of police searched his pockets."
"About four minutes into the video, EMS workers arrived but provided little emergency aid to Garner. One female worker, whom the Post named as Nicole Palmeri, checked Garner’s pulse before she walked away and left the man with police. The camera panned to other officers, who continued to stand around and stare at a lifeless Garner."
7 minutes & not one "professional" offers CPR to an unresponsive man.
At least 10 individual zeros standing around having a chin-wag looking impo tent.
Police commander texts subordinate Eric Garner's death is "no big deal."
The city ME believes Mr. Garner died of an asthma attack due to the hold, but other experts suggest he died of a heart attack while resisting arrest. Either way, the cop won’t be charged.
This is such BS. Even if he died from a heart attack during the incident, that cop should never have handled him like that. Over a fricken cigarette....that's where we are now, is it? We manhandle people over a fricken cigarette?
[quote=pknopp;55702894]The violate rights because they have known they can get away with it. That is slowly starting to change somewhat but this case shows we still have a long ways to go.
When you know that no matter what you do, the system will defend you, it's intentional.
When you are having a heart attack it feels like you can not breath.
Quote:
I thought the reporting was that he was still breathing even after he lost consciousness? You don't perform CPR on someone who is still breathing.
He was laying there dying and the EMT continued to instruct him to "get up".
In the case of Garner, the Federal Government ruled that there was no violation of civil rights....
So if Mr. Garner felt that he had the right to fight a cop to defend his civil rights, he was, in fact, resisting arrest and breaking the law which subjected him to his own death.

I can send you countless videos of New Yorkers stepping around and over dead or dying folks, it's pretty commonplace up there. Regardless of their profession, that town just doesn't lend a hand to help others.
