You are suggesting the SCOTUS should not decide if the laws are constitutional?

That would take more than an Amendment.

No. The “people” do not have a right to determine a basic human right like who you’re allowed to marry. What if your constituents decided they disliked heterosexual marriage (50% divorce rate ain’t helping), would you vote away that right for yourself and others? Doubt it. Basic human rights are not things that should change based on pandering to a constituency or reelection or religious belief. They are immutable.

I'm saying SCOTUS should be very conservative, originalist and reserved when exercising judicial review, deciding what's constitutional.

It is getting silly. You don’t like/approve of/support the right of gay people to marry. That’s what this is about. It’s not about some constitutional argument. It’s about you wanting to deny a basic human right to your fellow citizens. And it’s about you being too much of a coward to just come out and say so.

It's not a human right to have a homosexual union recognized and accepted. If people want to get rid of marriage law altogether then fine. I kind of support it at this point.

As a human who is also homosexual I would disagree.

It's a denial of someone else's basic humanity to say you won't accept it.

To me that's akin to throwing most all of humanity and history under the bus for not fully accepting abnormal sexuality. Not something I agree with .
