Fetal homicide laws are unconstitutional as they allow only some people but not all to kill an unborn child, at will. That's a violation of the 14th Amendment's Equal Protection Clause. Either anyone can kill an unborn child at will, or no one can. Can't have it both ways.

Your premise is extremely flawed. It's quite clearly a killer's personal business that they've decided to and have killed another. According to you, society has no right to probe into the murderer's personal business. But as we all know, that just simply isn't true. Killers are prosecuted for the results of their "personal business" every day.
When a woman is pregnant, she is carrying a fetus. Carrying is not passive.
