Justice Brett Kavanaugh wrote in a concurring opinion that he agrees that the CDC exceeded their power with the moratorium, and made clear that he was only allowing it to continue because it was about to end. Had Kavanaugh voted the other way, it would have been a 5-4 ruling to vacate the stay and Judge Friedrich’s ruling against the moratorium would have taken effect.

Yes. Trump gave it such authority in the CARES act he signed into law. The question was whether the CDC had exceeded the authority Trump granted to it. The US Supreme Court affirmed that they did not... although it was a sort of wishy-washy ruling that while it upheld the CDC's extension as lawful, in the opinion it explicitly did tell the legislature that they needed to get off their laurels and clean up the crappy work they'd done on the CARES act so it was more clear what authority they intended to grand to the CDC.

/Shrug. CARES act was mostly a Republican bill since Trump was President and the Republicans held a Senate majority. Unanimous in the Senate and close to in House.
How the hell does the cdc have the authority to even do this?
