That's like saying that somebody who tried to kill somebody else with a gun, even though they were far away and had little chance of landing a clean shot, is not guilty of attempted murder.
I'm sorry, but if you try to do something illegal, even if your chances of succeeding are slim, does not mean you aren't guilty of an attempted crime.
At this point, I think almost all of America (but the most stubborn of DemoDonkeys) want to take back the clock to Jan 6, 2021 and for them to succeed this time.
