It matters not what that Act says. If the judge(s) disagree with its meaning, they're gonna rule against it. Call it it activism from the bench - I don't care. If a judge says something is wrong, then it's wrong.

It's wait and see time to see who's right on this. Gotta say, I'm feeling quite confident.

Nowhere in the PHSA does it give the CDC carte blanche to abolish administrative procedure per the Administrative Procedure Act, nor to manufacture an emergency under which to wield nonexistent powers indefinitely.

We were in Mexico for the past week, flew back from Cancun today on JetBlue. I'd estimate 80% of passengers were not wearing masks. None of the flight staff were wearing masks
