WARN notices are only required if layoffs go above a specific number of employees and some companies do them in smaller groups over a period of time to avoid filing WARN notifications.

Musk and Tesla have a rather long history of thumbing their nose at laws. And then losing and paying a fine that well doesn't really matter that much. On the other hand, Musk is getting buyer's remorse on his Twitter purchase and getting increasingly desperate to back out of the deal without paying the $1 billion penalty he agreed to pay if he backed out. When you couple that penalty plus the penalty for the alleged WARN violation plus the subsequent wrongful termination lawsuits it might add up a bit. Probably not enough to really matter though but you never know with punitive damages in civil lawsuits.

I know how companies get around them. IBM would fire people across states to keep under the threshold for each state.

Wow...it's funny that you mentioned IBM. I'm a former employee and survived many layoffs but my business unit was sold to Lenovo. After nine months Lenovo sent our jobs to China and then I was laid off.

Me too. I managed to stay and actually retire from IBM. But my job when to India when I retired.

Not quite what the lawsuit is saying...basically sounds like they have agreements that they are to be given 60 day notices...that wasn't followed...if that is in the contract than the lawsuits are fair...if not, then they will be tossed.

I don't quite understand why the need to have a VP of LGBT relations or whatever...my BF works for a large corp here in Cleveland...they have a group of LGBT workers that meet on their own time together to support each other and to help educate the rest of the company about specific needs and what not...the company supports their goals to help it become a more inclusive place...including the company marching in our Pride Parade a couple weeks ago. But they didn't need a VP of LGBT relations or whatever...
