My best friend's mother got a DUI at exactly 0.08. She'd had two glasses of wine. She's a successful chemist in her 50's who'd never been in trouble with the law at all. The judge gave her a choice:
1). Fine. Alcohol and driving classes. 12 month restricted license that allows driving only to and from work.
2). Fine. Alcohol and driving classes. Complete revocation of license for 3 months.
For what I would consider a minor DUI (1st offense), I think those punishments are reasonable. (She chose complete revocation for 3 months, if you're curious).
So you go to a baseball game and have two beers. You are .08. Do you believe you should lose your license for this for a year? You may lose your job and be ruined.
2 beers will not get you to .08 unless you chug them one after the other. You're well within a safe BAC to drive if you down 2 beers within the space of a 3 hour baseball game. That's pretty much my own personal rule....if I'm driving, my limit is 2 beers. If my kids are with me, I won't drink anything and drive. Although I don't drink all that much anyways.
Fair enough and good on you! There is still the whole argument these people are sick and need help. Of course, this may not apply to someone with seven DUIs. Maybe 1.

Well, the fact she chose 3 months complete revocation surprises me. How did she get to and from work? I think I'd choose the year option to "reflect."
In other words: If there's alcohol on your breath, it WILL sting.
Repeat offenders should have their license permanently revoked, bonded with some substantial fines and possibly community service (or jail if they prefer that).
It's really simple, if you drink, even one beer, you'll get a ticket and it'll sting. That should do something about it.

Maybe some of these people do need help, but that shouldn't mean that the penalty should be any lighter because someone is an alcoholic. If anything, they should revoke the license of an alcoholic for much LONGER, because they are more likely to drive drunk again.

So, since you don't, you take the position that everybody else shouldn't do so legally?
You know I never said that. Quit twisting my words. My point was that I don't drink and drive at all so the chances of me geting a DUI are slim to none.
