It absolutely can. Racial derogatories used in the commission of a crime put the actual crime into the realm of civil rights violations, which in turn has its own penalties and punishment. The actual crime is irrelevant. But once you utter a few words, you've shot yourself in the foot.
Your argument is completely illogical. Hate speech in the commission of a crime can be a factor at sentencing, but there has to be a crime committed. No crime = no offense

So what liabilities or actual damages have "hate" vibrations of air caused at any point in history? I can understand, to some extent, slander that may cause actual damage in business and the like, but "hate speech"? Hurting people's fragile egos, offending them, is hardly an initiation of force. An actual direct threat, I can understand, but that is not what the censors of this world are screaming about, and there are already laws against this.
Although, it is perfectly "okay" for our Resident to rile up the drooling proletariats against the evil "rich", demonize an entire industry to further his authoritarian agenda, or belittle entire factions of the populace who disagree with his policies. That's fine to the would-be censors I guess.

"Free Speech" doesn't mean free of consequences. It means free of prior restraint. Since colonial days we've held people responsible for the damage their "free speech" can cause.
In the colonial days, a person was challenged to a duel if something someone said was found to be offensive to another. No calling the police. No crying to the ACLU. Straight-up duke it out and resolve the issue on the spot. Now we have liberals crying all over the place as if the feelings of another person are some sort of sacred entity deserving of perpetual coddling. And this is exactly why liberalism has turned the USA into a nanny-nation, full of people who see individualism as nothing more than an extension of the overbearing hand of government.
As President Tyler said to complainers: "Go home and hammer out your own salvation."

Let us put this in perspective. A person draws cartoon of prophet Mohammad. Exercises free speech.
Another person, or a group, finds the cartoon offensive, and speaks out against the cartoonist even threatening to kill. Is this free speech or hate speech? How do you classify? And how do you support your classification? (evidence always helps).
