He's not flying out outside the home. He has the flag in the window. At first they told him if it wasn't taken down they would be evicted. Then they agreed to allow him to keep the flag up for Memorial Day weekend but then it has to come down. So when exactly did the American flag become offensive?
Another one of these threads....you know darn well by reading (did you read?) that it's against the rules of the complex to have flags, regardless of what kind of flag it is. Quit assuming the victim role for at least one day, it's tiresome.

This is why I will never buy a house that has a HOA.
It is not an HOA. It is a landlord. He is a renter. The HOA cannot ban flags but can regulate the manner in which they are displayed (no yard poles and no using as curtains). You might not like the HOA rules and if you don't, don't buy where there is an HOA but I will tell you this- drive through any neighbourhood with and without an HOA and you can see the difference right away.
HOA's cannot ban the American flag* in cases where the flag displayer has an ownership interest in the property. That's not a constitutional issue so much as a property rights issue.
Tenants do not have such rights.
*Interestingly, the law doesn't mention OTHER flags, so it's pretty flawed...

I don't agree with the landlords, but it is their building. They have a right to make whatever rules they want in their building. It also looks like they enacted the rule to avoid any conflicts. They are applying the rules to everyone, what is wrong with that? Do you want the government to intrude on private property? Are you a Communist?

It's illegal to discriminate concerning housing because of race.
If your apartment has rules about displaying items (of any kind) in their windows, then you have follow those rules or seek new housing.
His only leverage would be if others are displaying items and not being told to remove theirs.

Evidently you are unfamiliar with Fair Housing laws.
The flag issue would be a first amendment issue of the landlord was the government, but since it isn't, there's no first amendment issue either.
