Too bad we did not have one of YOU!! No form was ever shown me or even discussed...I was shocked that an agt could even entertain the idea that a general customer would KNOW protocol about real estate (very bad assumption ). I learned quickly once I found a property and a good buyer's agt. but before that had no idea.

This gal even lit into me saying she had just had a baby and she made time to show me a listing of hers so she "deserved" to be the buyer agt.

Eight months is a very long time. I was under the impression the OP's transaction was a very short period of time.

I'm having a hard time believing that anyone would call a real estate agent, and ask to see a house - and not expect to pay a commission, if you eventually buy that house?

If you want to use a different buyer's agent - then call that agent from the start. Seems simple enough!

I think they were looking on the website for months, not out looking with the agent for months.

I'm the OP.

No, it was just a few months of website searching. This was the first listing I requested a viewing of any of the homes listed. She did show us another that same day in the neighborhood. No papers were signed and no verbal agreements were made between us. She never even mentioned the words 'Buyers Agent' until the late night phone call.

I emailed my apology to her and all has been straightened out as of noon today. My inexperience with the realtor/broker/agent system is part of what caused the issue. I cannot be faulted for the way the profession is set up to handle buyers and sellers. It all seems mysterious and stand-offish to me. She should have been more forthcoming in her area of expertise IMHO.

I met the Buyers Agent I located this AM and have since found out she did not follow the letter of the law in this state regarding Buyers Agent disclosure. Anyway, he went thru a long explanation of his duties (he is an Exclusive Buyers Agent). Then he went through the complete process of the offer (which we made and am waiting for the response), and explained EVERY step of the buying process in detail. My wife and I felt very informed, comfortable and satisfied after the meeting.

Not informing me of the legal aspect of her duties was unprofessional.
Her actions during the walk through of the first showing was unprofessional. Her late nite frenzied phone call was further proof of unprofessional behavior. I told her I was confused and she still continued to yell at me. If she were to pursue any action I feel the Board of Realtors would side with the customer (me) in this case.

Again, thanks for the answers and critiques. I'm a truck mechanic not a realtor. Not knowing the realty business is not a sin.

The advent of the IDX system where listings from most companies appearing on competitors websites is extremely confusing to consumers. I get calls all the time from people thinking a listing is mine. I don't fault the consumer for not understanding our system. The OP is one of MANY confused consumers that contact we agents.

We have agency disclosure laws for a reason. We know our system and laws are confusing. This is part of our job.

I'm not an agent - and you are - so clearly you're more knowledgeable about that aspect!

But I have to say that if I call an agent, and ask them to show me a property, then I most certainly assume that if I buy that property, they're entitled to a commission. I can't imagine thinking anything else - it's such a basic concept.

Like I said before, if you want to use a different buyer's agent, then call that agent to begin with.

If you have bought a house before maybe, but first time home buyers and seniors that haven't bought in a long time are often confused.

People think that the agent on the IDX is the listing agent when it isn't. They don't get that they aren't calling the listing agent. I don't think it is that simple. The OP didn't understand that the person they were calling wasn't the seller's agent. That's who they thought they were calling. Clearly the "buyer agent" didn't clarify that she wasn't the listing agent.

My point is that it doesn't matter if it's the listing agent or not. If I call an agent, and have them show me a house - even if they're the listing agent - I would expect to be committed to paying a commission, if I buy that house.

Personally I would never call the listing agent and ask them to show me a house, because I want my own buyer's agent. But if you call the listing agent, and expect them to show you the house, and then don't want to pay them? That's just wrong in my book. And I'm surprised that anyone would think it was okay to do that to an agent.

I show listings to other agent's buyers all the time. It's my JOB. I think it is horrible advice to tell someone that have to use an agent just because they showed them a house. What if when you met them you thought they were idiots? You hated them? You want that person to represent you? No way. Consumers have choices, as it should be.

The OP made the right choice for them. They found an agent they trusted and used them. This is a huge financial decision and consumers need to use people they trust on it. That might not be the first agent they meet and go out with.
