I'm not really sure why he's accusing her unless he wants more than his fair share of the marital estate or he's just trying to get under her skin.

He's a terrible person and she has been a saint putting up with him all these years.

Well, his lawyer's not advising him wisely; he can say anything he wants, he's going to get 50.000% of the community property. She can be a saint, she can be evil: he's still going to get 50.000%.

Far better for both involved to be putting effort toward an accurate assessment and division of the community property.

Well there are some circumstances she has told me about that may impact how the estate is divided (mainly having to do with him spending her money on his separate debts without her knowledge/permission).

Their lawyers will have to hash that out I guess.

I didn't think Texas was straight 50/50 though, it just calls for an equitable division of assets.

OK...on further reading, I've found out that Texas IS a no fault state, however, Texas CAN consider extenuating circumstances, and it CAN effect property division. Adultery IS one of those circumstances. Also, cruelty, abandonment, and conviction of a felony.

Well, the article said it wasn't necessary to have "a smoking gun". I'm not quite sure how that shakes out...

But maybe she could counter-sue for cruelty.
