Hello:

A week or so ago I asked about how to proceed with a landlord that would not make repairs. Right as I was following the helpful advice provided by you all, I was notified that the property is now in the process of being sold. (This makes it even more clear why the landlord was ignoring my repair requests!)

Now, I have done some research and know with certainty that the lease transfers to the new property owners. What I do not know about it the following:

The closing date for the house is the 29th of August. It is my assumption that upon closing, ownership of the house is passed from the original owner to the new owners and hence the rent I pay for September should be submitted to the new landlords. I tried my best to find something detailing this in my lease and TX rental laws, but was unable. I also emailed my "old" landlord and he said I should submit the rent to him. Given his track-record and my confidence in him, I would be remiss if I took him at his word.

Does anyone know the legal process here?

Have they contacted you in any way?
Has anyone had you affirm IN WRITING the particulars of your tenancy??
(things like the exact rent, amount of deposit)
Has anyone toured your unit for a condition inspection ? Taken photo's?

They should have.

For the immediate period though...
I say be less concerned about the "legal process" than the common sense "process".

Let 8/29 pass and see whether the closing happens (or not).
If the current LL still own's the property on 9/1 then pay him.

If they don't... then cross that bridge when you get to it.

I have not met the new landlords and they have not contacted me. The realtor has been by all week assisting with sale inspections, land surveying, etc. I talked briefly to the realtor when I was able to and the rent will remain the same (as per the lease which terminates in May).

I shall just be patient and wait for the closing date to pass and then take it from there, as advised. Thank-you!

The new owners have to honor the lease and the deposit will be tranferredd to the new owner. The new owner cannot contact you until the sale closes. I would not worry about paying rent until after the 29th and see who owns the property. The real estate agent can tell you who the new owner is when it closes.
