Our new apt sent everyone a notice about how they'd soon be implementing a non-smoking building...including balconies.

As a smoker, I absolutely understand not smoking in the common/community areas but on your own balcony? I live on the 15th floor (top) and i feel that no smoking on balconies is excessive.

Thoughts?

I'd move....right now.

No...better yet, I'd sue them for breach of contract if that wasn't included in the lease agreement.

Smoke from balconies can be sucked into the interior through windows and a/c units and such a ban is not unusual at all. And implementing a no-smoking rule in apartment complexes may not be a lease breach at all unless your lease specifically says that smoking IS permitted. Check your state laws.

I would think they could only impose this new regulation in your new lease renewal and not any old time they feel like applying new regulations to your tenancy..

I'm a non-smoker, never smoked in my life and find this utterly ridiculous.... I've been outside, walking on the sidewalk and smelled smoke...but what can you do...you can't keep taking rights away from people...Smokers now...who and what's next? Crazy!

Here's what the notice says...

"On May 1, 2012, a no-smoking policy will be in effect for all new and renewing residents. This new policy will be a contractual obligation for all residents, occupants, and their guests, and will be documented in a Smoke-Free Lease Addendum attached to the lease.

Though we are initiating the smoke-free policy at our community now, it will take at least a year to complete. As a result, by early May of 2013, we anticipate that all residents, occupants and guests will be subject to the policy.

It is our goal to make the community entirely smoke-free, to include the balconies..."

So...yeah, I'm a little confused. It starts on May 2012 or May 2013?! I don't remember reading anything about smoking on the lease, but I will take another look at the lease..

So ridiculous.

What the notice is saying is that new residents will sign a lease with a no smoking clause and that when current resident renew their lease there will be a no smoking clause. So you are free to smoke until it's time to renew your lease.

This is the reason I do not rent in the city and have neighbors and within the next 12 months I will have my own land and my home built and smoke where I want when I want.
