I'm renting a room to someone who has not paid me in over a year. I never gave him receipts and since this pandemic started he's been asking for them. To be fair he's only asking for the receipts for the months he paid, he even told me to put the balance he owes on them If I want. He says he has me recorded acknowledging that he paid me, I asked him to play it for me and he won't so I think he's bluffing. If he isn't though can he use that against me in court? I was recorded once before so I'm just really paranoid about this.


I was gearing up to go to court today then he slips a note under my door with a letter from the city, he applied for rent relief without my permission! It says I can't evict him while his application is "under review" - is this a tactic by the city have people like him rip me off more?


Also in regards to recording, I called the police on this guy 3 months ago, although there was nothing he can do he did knock on his door. The cop was really cool and gave him the business. He had 2 cats in his room he said he was watching when I specifically said no pets. The officer gave me his name and shield # and told me if I needed further proof regarding the cats that his body camera could be used as evidence if I needed to prove he broke our agreement. (The cats are gone now, but he still violated the rules) - I have been trying to get ahold of the body camera footage and on a section of the nypd site it said to email foil@nypd.org and when I did I got a bounceback telling me that I didn't have permission to send it to them. I tried my Outlook email, gmail and yahoo mail and got the same message. If anyone has any suggestions I'd appreciate it, thank you

You could have evicted him for breaking the rules when the cats were there. Why didn’t you?

The cats are gone. Game over. Please stop bothering the police for something that has zero value to anybody for any purpose whatsoever.

I can't believe that your police has so little to do that they would respond to cats in a rented room. Despite a written lease, that's a civil matter, the tenant didn't break any laws, so I'm wondering if this post is made up.

Probably. A lot of places have laws that you can't evict after the tenant applies for rent relief. You really need to consult a lawyer about your local law. If nothing else, find your local landlords/ apartment owners association and join there. They usually have a lawyer on retainer who keeps members updated on all new laws and procedures.


If you are renting out a room, then you might not be subject to the same landlord tenant laws as a landlord who is renting out a separate house, Rooming house and boarding house laws are different. It's generally a lot easier to get a tenant out of a rooming house.

The police will (and should) respond to calls and reports where mental illness/mental instability may be involved. Sadly, that may be OP's situation.

How about calling the city to verify if he has applied for rent assistance.

And why wouldn't you give him rent receipts for the months that you know he paid rent? Are you subletting the room in violation of your own lease

Did you ever have him sign a contract to rent the room? If nothing is signed, he's legally considered a "guest" and you can have him removed. The sherrif will escort the person off the property. Be prepared to change your locks.

I believe that all forms of rent relief are paid directly to the landlord. What state do you live in? The rules are different in every state.

Not true everywhere. I know several landlords who had rent relief paid directly to the tenant, who then did not pass it on to the landlord. I also know a heck of a lot of landlords who have tenants who have applied for rent relief and everybody is still waiting and waiting with no sign of any money.
