My new next door neighbor installed a kitchen sink in his garage and drains waste water to the fence. Unfortunately for me, my side is lower and the waste water collects on my side. Is this even legal?

I talked to him about the water collecting on my side. I am waiting to see what they will do to resolve it. What do I do? I have my side setup with a small table and some chairs so I can relax outside once in a while. Now I am looking at and smelling their waste kitchen sink water if I want to sit at the table on my side of the fence.

No, that's not legal. And even a brainless inspector would have caught it, so I doubt very much that the work was permitted - just call code enforcement on him.

The thing is I already talked to them about it. If I call code enforcement, they will know it's me. I have to live next door to these people probably for a long time. I should have just kept my mouth shut and called code enforcement instead.

What you are describing is called a "gray water drain". Surprisingly some municipalities allow limited use of them. What I would recommend is that you first go to your City WEB site and find their Code Of Ordinances (hopefully it is available on line) and look to see if they have specific language allowing it. Next you can call the City Code Enforcement Department and ask if there are any restrictions regarding gray water drains.

In any event even those municipalities that might allow it would also require that all drainage be confined to the owner's property and not cause a nuisance to others. Your best bet is to work with your neighbor to solve the issue even if it means providing them technical guidance to help prevent it causing you issues. Once you've exhausted that avenue you really do need to speak with the City. You don't really know what they are dumping out there and if you try to sell your property it could become a problem for you.

I would make a complaint for unpermitted work it should not drain into your yard.

If you live within a city limits it’s very unlikely that you can dump gray water on the ground. It may be allowed in a farm/unincorporated area
