Is it true TX state cannot enforce penalties against someone out of state - IE CA. How can I get TX OAG to open a case with CA so that CA can enforce the penalties - Ex avoiding work to pay for CS/lives at home with his mom. I cannot remember the new address she gave me!!

Have you tried contacting CA directly? I've heard they're pretty proactive on CS cases. As far as her addy, if you know her name, try some online searches.

The Uniform Interstate Family Support Act (UIFSA) made it possible for all state and tribal child support agencies to pursue child support enforcement, including locating an absent parent, paternity establishment and establishment of support obligations.

When parties don’t live in the same state, or even in the same country, the Child Support Division works with other child support agencies to successfully establish, enforce, and/or modify an existing child support order.

In some situations, a non-custodial parent is unemployed or does not have a stable employment history of which to refer when making determinations regarding a child support obligation. However, even if a person does not have a job, he or she may still be required to pay child support.

Texas does not tolerate child support evaders. Parents who fail or refuse to pay child support can go to jail for up to two years and pay thousands of dollar in fines – on top of the child support they owe.

Liens can be placed against property, cars, bank accounts, retirement plans, and other assets if you are in arrears. The lien will remain in place until the debt is satisfied.

If you owe more than $2,500 in child support, you are not eligible to receive a U.S. passport.

Past-due child support doesn’t ever go away.
In fact, the amount will just continue to get bigger because the state charges interest on unpaid child support. The state can go after and collect unpaid child support even after the child becomes an adult.

To the non-paying parent... what this means in real life is once they find you, TWO state's Attorney General are gonna make your life miserable.

Sounds serious. I hope those laws apply to someone that is living in California (like this person is) as well. I guess, if the person truly is bent on not paying, they won't. Just have all of those negative things happen to them.

As they danged well should. I have ZERO sympathy for a deadbeat parent, male or female. Paying CS may not be easy - but raising them isn't cheap. And when you see parents trying to dodge a $3-400/mo (or less) payment, that's just wrong. And yes - I know it can be higher - but that's because the NC parent has a higher income, as well. What I don't agree with is when they try to go after the income from the ex AND their new partner.

Back in the day, even if a person wasn't working for whatever reason and they were supposed to pay child support, they had to pay the amount based on a percentage of minimum wage. Not sure what the law is today but that's what it used to be.
