A buddy of mine was arrested years ago(back in 2009 In Fairfax Virginia), he could not pay his Restitution during that time but now he could pay it.

He had a letter send in the mail stating he should.

He can pay it but is afraid that if it had went up. Can Resitutions go up if you do not pay it?

Or does it stay's the same?

It depends on where it was, who the judge is, and what it was for.

Honestly, I have seen judges tack on additional charges such as contempt of court, and failure to comply for non-payment of fees if they aren't paid in full (or a darn good reason why they aren't paid) by a certain time. Also, has he missed ANY court times? That can get him a failure to appear charge, which carries it's own fines and fees and possibly jail time.

If I were him, I would call and check on everything before I sent a check.

No.

He had not missed any court dates.

Also the charge was breaking and entering but it was not at a home, just a business-like place short of speak.

Plus he did pay his court cost.

Also forgotto mention that he did so up on time on his probation until it was terminated after he left state
