I was discharged from my employer due to not being a good fit back in October of 2013. Applied for UI benefits and received a weekly benefit of $427 a week. I found full-time employment in December of 2013 (EDD was still giving me partial payment as I was not making enough) and just got laid off on 2/18/14. When I get my new claim form I am planning on stating laid off in the box that says reason no longer working. Will EDD start a new claim or exhaust the one I have until the benefit year is up in October of 2014?

Unhappy EDD. Laid off. Will still receive the same weekly benefit amount.

I was fired from my employer in October of 2013. I applied for UI and was awarded a weekly benefit amount of $ 427 weekly. EDD used the standard base from my previous employer back in 2012 to calculate my weekly rate. I ended up finding full time work in December of 2013. EDD was still giving me partial payments because I was not making enough. I got laid off from my full time work on 2/18/14. I will be getting my new claim form soon and I will be putting laid off in the box where it says reason no longer working. Will answering laid off be ok? Also, will EDD make me open a new claim or will they continue to give me the same benefit amount until my benefit year is up in October 2014? Thanks in advance

They'll continue to pay you the same weekly amount of $427. They'll do that until the claim expires or you run out of money on the claim, whichever comes first.

As a caution, if there is any doubt as to whether you were laid off, discharged, or you just work for a slimy employer, pick discharged. CA will hit you with a false statement penalty of no less than two weeks if there is any doubt as to why you're not working there.

Employers have told claimants they were being let go for "financial reasons," "things are slow," or "your job duties are being given to someone else." All those people that reported here picked "laid off." Sure sounded like it. Then they had to deal with a false statement penalty. It's not worth the trouble to appeal when just picking "discharged" would have still resulted in benefits without the penalty.

As said, you'll continue on the same claim.

Same thing happened to me in WA... lost job June 2013, approved for a claim but then started a new job a few days later. Was laid off from that job in January and I went back on the original claim.

Good thing for me is I worked enough hours on that job to qualify for a new claim at my BYE this coming June. That's another 26 weeks of benefits and I avoid the EUC mess.

You could be eligible too if you have enough hours worked.

I made sure I got a separation notice with "Laid off - Lack of Work" stated and signed by my employer. I wasn't going take any chances on them saying anything but those facts.

It wasn't an issue thankfully. Some people aren't so lucky.

Wow. I had no idea "laid off" would be so bad. I asked for a letter, but my boss said edd will send her something. I think putting down "discharged" is my best bet.

Probably. "Laid off" is fine if you have the documentation to support it. A separation notice is required by law from your employer in some states.

As it turns out WA ESD sent my employer some paperwork that said "Employee says he was laid off... please confirm" and he responded with "Laid off - Lack of work" just like he put on the paperwork he gave me... I'd rather have it in writing and avoid any future investigations/delays caused from inaccurate info.

Should your employer decide to say something like "He just quit showing up to work" what happens then? It's your word vs his word and your payments will no doubt be delayed. It's drama I'd rather not deal with.

I will be laid of on 09/30/2013. My question when do I need to applied for unemployed and I do have prof of it. MY supervisor give me termination letter is that good enough to prof.

If you earned $640 gross per week in at least one quarter, your quarterly earnings qualify you for a weekly benefit of $321. ($640x13=$8,420 = $321 WBA)

Total base-period earnings will determine how many weeks' benefits you receive, up to a maximum of 26.

To receive a benefit of $321/week for 26 weeks, you need $16,692 total earnings in your base period. If total earnings are less than $16,692, divide total earnings in your base period by 2, and then divide that number by $321 to determine number of weeks you qualify for.

If you apply before October 5, CA will use earnings during the April 2013-March 2014 base period.

If you apply October 5th or later, CA will use earnings during the July 2013-June 2014 base period.

If you've only been with that employer a short-time and don't have other earnings in your base period, CA may need to use its Alternate Base Period to qualify you, which will include earnings to the most recently completed quarter prior to the date you apply.

Apply online. CA will also send an inquiry to your employer based on the information on your application. Keep the termination letter. CA may interview you before it approves benefits.

Thank you so much But I have been working at this company since 2012. Only 26 weeks. That's the maximum time I will get unemployment.
