that is correct that in order to receive PUA you have to be found ineligible for regular UI. I think CA was quick to push a lot of claimants through as PUA claims just to get payments to them and then reassessing the claims later on. This is interesting from federal guidelines to the states (16-20) on PUA.
C. Operating Instructions:
1. Eligibility.
Section 2102 of the Act provides for payment of PUA to “covered individuals”.
“Covered individuals” are those individuals not qualified for regular unemployment
compensation, extended benefits under state or Federal law, or pandemic emergency
unemployment compensation (PEUC), including those who have exhausted all rights
to such benefits. “Covered individuals” also include self-employed, individuals
seeking part-time employment, individuals lacking sufficient work history, or those
otherwise not qualified for regular UC, extended benefits under state or federal law, or
PEUC.
so maybe after review a lot of the PUA claims will be switched over to other programs they were supposed to be collecting under. So if someone was exhausted under regular UI benefits and CA quickly threw them into PUA they now are coming back and switching them to PEUC because they are entitled to PEUC first and therefore not entitled to PUA. Makes sense to me.????
