My husband worked for an employer as a telecommuting employee from last Nov to this April. He was a contractor before then. The employer is in CA, we live in NC. Where does he (or can he) file for unemployment..to CA or to NC? He filed in NC and never heard anything.

He applies for wherever state is withholding taxes on either his 1099 or W-2 (as a contractor) or now his W-2 as a telecommuting employee. NC will look at wages earned (in NC) for the last 8 quarters prior to unemployment, and will suggest he go first to where he has more quarters earned. He needs a minimum of 2 quarters to file in NC. It does not appear that he has that if he worked November to April. I don't know what the rule is in CA. He cannot get unemployment if he was on a 1099, but can as a W-2 employee even as a contractor.

Can we assume that you didn't LIVE in California and your hubby telecommuted from your home in NC?

He needs to call the Unemployment office in NC and get some answers. If nothing else, he can find out if his claim is still in the review process, which can takes many weeks in some states. Also, he needs more clarification regarding what state he needed to file in, since it sounds like he's not sure. They should have told him what to do when he filed.

Some states do a poor job of keeping folks informed and you need to do your own follow-up. You may not know if you've been approved for benefits until you get a bank statement and see the deposit from the Unemployment Commission.

Ok, the CA company paid taxes to NC. Prior to that he was 1099 for a few yrs. Is there a certain length he had to work W-2?

In NC, 2 out of the 8 quarters prior to being unemployed.

Actually, I just read that the first 4 of the last 5 quarters is the base period. You have to be employed 2 quarters in the base period. So he wasn't eligible the first time he applied, which was in May. But now that a quarter has went by, according to this, he would be. He has reapplied online, but this seems weird...what are we missing?
