OK folks questions here. this friend lives in the state of West Virginia and is in a tight spot. Her husband who is bi/polar/ausberger had to be put in jail today for death threats against her ,this has been going on for a long time and perhaps this manic phase was just to much for him. They owe a pretty hefty amount to the IRS and due to his 'disease' it's just a never ending problem. Does this women have any options as far as courts /laws that can cover her getting away from the situation as in a long way away.She is in fear of her life and living in fear of the law or IRS seems as bad as facing the danger from her husband.She has been told that no matter the situation she'll remain accountable and remains fearful of both sides...
Does anyone know about this new bill being passed about the travel and passports.

IF she was married to him & filed a Joint IRS report then YES she just as responsable After the DIVORCE! Her best bet is to contact a lawyer that deals in Taxes & Divorce. Maybe they can work something out with her paying her part of the bill. She can live anywhere in the US But Cant leave the country til her bill is paid...as far as I know BUT again the lawyer can answer for sure.

thanks Katie ,this man wants to fight off any suggestion of compromise and just keeps digging a deeper hole.Just looking for answers that might help.

This is an obvious, "talk to a lawyer a question." A lawyer is much reliable than strangers over the internet. That is the best answer to your question.

Im not implying anything, but inquiring about passports and leaving while stating a person owes the IRS money and is involved in some legal situation is kinda shady.

this seemed to have a lot of hidden items in there when it came up such as

Does this apply in all cases? Mercifully no. You could travel if your tax debt is being paid in a timely manner or in emergency circumstances or for humanitarian reasons. But this isn’t limited to criminal tax cases or situations where the government fears someone is fleeing a tax debt.

In fact, if the bill is passed you could have your passport revoked merely because you owe say $60,000 and the
IRS has filed a notice of lien. Bear in mind that the IRS files tax liens routinely when you owe taxes—it’s just the IRS way of putting creditors on notice so the IRS will eventually get paid. See Tax Liens Means IRS Thinks You Owe. In that sense, this you-can’t-travel idea seems pretty extreme.

Some commentators note that a far smaller sum of

You are talking about two issues here.

First the tax issue. It would seem they are equally responsible regardless of current or future living circumstances. If she were to get a legal separation or divorce, she might be able to negotiate a separate agreement with the IRS for her part of the obligation? She needs to ask an attorney. If she doesn't have any money she can ask legal aid.

Second is the living arrangements. I do not subscribe to the notion that somebody is just too weak to walk out the door. If she is truly in fear for her life, she would have to be an idiot to stay there. She could get a job, even a minimum wage job, get a room somewhere, and apply for food stamps. She would get bye. My experience with dealing with people like this is they sometimes have a sickness themselves where they somehow associate the threats or violence with love, and either stick with it even if they have been harmed, or return to it if they leave. They just can't seem to make it (emotionally) without being around their darling abuser. If that is the case, she needs to get professional help fast. And, by the way, it happens to men almost as often as it does women. Many men stay in abusive relationships for the same reasons.

The abused person also generally has very low self esteem.

Ask yourself this question... has this person tried to leave or left, then gone back? Has this happened more than once? Has she remained, or left and returned after being physically harmed. There is generally what is called a "cycle of violence" that accompanies relationships like this. The abuser slowly builds up to the abuse, then after the abuse becomes apologetic, nice, loving, etc. Then the situation repeats itself over and over again. You might have two people who need professonal help here, but it is crazy for her to risk remaining in this relationship in any event. I don't know about the passport situation. I think if somebody is not allowed to leave, a passport is confiscated by the authorities, but I don't know that for a fact.

Your friend should go to the nearest mental health facility and ask for help, and she should go to a magistrate and ask about the procedure for getting an order of protection to keep him away from her.

Also, if they have money maybe they should buy some protection. Being armed is never a bad thing.
