I'm not sure for which program to file. I had a work injury that resulted in MMI on Dec 20th. I was just laid off today. I had modified duty/part-time work (tho full-time status) until this point.
My disability rating is 15% according to my work comp doctor. My employer was understanding and told me not to do my usual work, but was unable to provide full-time modified work. I don't argue with any of that; we didn't have work for me.
I signed a C&R with Work Comp, and I see one of the requirements of SDI is being under the care of a doctor. I won't meet that requirement now that I am off WC. Does this mean I should file for unemployment instead of SDI?
Also, how long does it take for these programs to process claims? Is one faster than the other? Could I file for SDI, wait to see if I am accepted, and then file for UI if I'm not? I don't want to lose UI eligibility while I wait.
Collection of unemployement will not hinder collection of SSDI. Yes, if you want to pursue a claim with SSDI you do need a doctor. Most of SSDI's research and varification of eligibilty is heavily predicated on these vouchers from you doctor, or doctors. You should see one soon and at the beginng stages to clarify what they need in your specific ailment and your work. SSDI first overviews your entire case both physicall and mentally and also dicsusses your condition with them. It takes anywhere from 6 weeks to 6 months before their case on you is completed. In the meantime collect unemployment benfits and rules based on the state.
Go on the internet and write SSDI qualifications (for the State you are in and it will layout all the information and requirements and process0. I said State in my first sentence, but I do believe it it a federal program. Just type what I suggested in the browser and you'll find it - the state or or federal regulations. Type in Social Security Disability service - exactly that way and the government's State or Federal will pop up for you and give you the precise qualifications and doctual requirements pertaining to your condition.
