LongtimeBravesFan is not my real name, so I'm not worried about getting in trouble for time card fraud. I am only claiming the time I actually worked, the extra 30 minutes is taken off for lunch, which is not paid.

Without going into detail, I work as part of a group that visits different locations every day to perform a certain task. We work until the task is over and then we leave. We take a short 10-15 minute break during the day, but not a full lunch. Everybody is cool with doing it that way.

I was hourly employee that worked a 8 hours shift and was not given any breaks and was not able to take my lunch until the sixth hour, is this legal in California and if not can I recieve back pay?

I don't think it's legal for CA...as that is too much time before lunch time started. Not sure about the penalty or any backpay for this. Or if certain companies are exempt. You will have to research the CA law.

Some of ya'll clock out for lunch? The only time I have ever had to do that is if we left company property, I did have a long term job where we didn't punch a lock and could take lunch whenever we wanted but HAD to take 30 minutes at some point during the day(NO, it couldn't be at the end of the day).

This is why I'm glad to be FLSA Exempt. I HATED dealing with punching in and out.

Salaried is so much more enjoyable.

CA has some very strict laws about when lunch must be taken. Even if you don't clock in/out. Hourly employees have to take lunch and it has to be a certain number of hours after their start time. Even if the employee doesn't want to take a lunch or doesn't want to take lunch that early. It's a very strick law in CA.
