Texas Health & Safety Code - Minimum Standards of Sanitation & Health Protection, Chapter 341.064 and FW Ordinance #12156-Sec 16.459-462 (Sep 12, 1995). An owner, manager, operator or other attendant in charge shall maintain the pools, spas, bathhouses and the surroundings in a sanitary condition at all times.
The wainscot of the pool/spa are not maintained in a sanitary condition. The wainscot of the pool, spa, their component parts or bathhouse and its surroundings are not maintained in good repair.
Corrective action: Maintain wainscot of the pool/spa so they are sanitary. Clean tile within 7 days. Maintain the wainscot pool, spa, their component parts or bathhouse and its surroundings in good repair at all times. Replace missing tile.
- Pool Yard Enclosures
TSSP&S 265.200 (Eff Oct 1, 1999) - Pool Yard Enclosures, pages 60 - 62 and FW Ordinance #12156-Sec 16.459-462 (Sep 12, 1995). Pool yard enclosures shall be designed, constructed, installed and maintained to comply with all applicable provisions of City of Fort Worth Ordinances and the State Standard.
Adequate gates/doors are not provided. Adequate enclosure is not provided.
Corrective action: All gates or doors for pools and spas (other than new Class A & B pools) shall be lockable and equipped with self-locking and self-latching devices. An inaccessible opener mounted on the enclosure shall be installed at least 3.5 feet above the deck/walkway surface, shall open outward away from the pool/spa and shall be latched when the pool or spa is not in use or when nearby or associated pools/spas are closed as a result of a hazard or other unsafe condition. All ingress and egress to access a pool or spa shall be through common pool enclosure gates or doors. Office door shall shelf-close and latch. Gate by the pool pump shall self-latch (latch is missing, chain shut until repaired. Correct within 24 hours. The enclosure for all pools and spas (other than new Class A & B pools) which may include a fence, portion of a building, wall or other durable enclosure not associated with private premises shall have a minimum effective perpendicular height of four (4) feet measured from the deck surface on the outside of the fence, shall not be readily climbable with horizontal members less than 45 inches between their tops or have vertical members more than four (4) inches apart or a space below the fence greater than 4" inches. If the horizontal members are less than 45 inches apart, the vertical members shall be spaced no more than 1 " apart. Class C pools with chain link shall have until January 7, 2007 to comply with the city ordinance. Planters or other climbable structures shall not be within 36 inches of the outside fence. Move all items away from the pool fence.
- Handholds Specific Safety Features
TSSP&S 265.199 (Eff Oct 1, 1999) - Specific Safety Features, pages 52 - 60; TDSPSPC 337.80,TDSPSPC 337.93,TDSPSPC 337.96 (Eff Jun 13, 1965) and FW Ordinance #12156-Sec 16.459-462 (Sep 12, 1995). Safety features and equipment shall be designed, constructed, installed and maintained to comply with all applicable provisions of City of Fort Worth Ordinances and the State Standard.
Properly designed "NO DIVING" markings are not provided. No diving symbol on the sign is less then 4 inches. Ring buoy is not at the pool. No address sign at the emergency phone.
Corrective action: At class C & D pools where no lifeguard is provided, a securely mounted sign which is readily visible to swimmers with the warning words "NO DIVING" and the international symbol for no diving with letters at least four inches high shall be placed in plain view. Keep the ring buoy at the pool. Do not lock away. Corrected. Provide a sign with the address of the pool at the emergency phone.
- Operation and Management
TSSP&S 265.203 (Eff Oct 1, 1999) - Operation and Management, pages 64 - 66 and FW Ordinance #12156-Sec 16.459-462 (Sep 12, 1995). Pool/spa operators and managers shall operate and manage all pools and spas to comply with City of Fort Worth Ordinances and the State Standard.
Personnel in charge of maintaining a pool or spa is not properly trained regarding chemical hazard prevention.
Corrective action: Personnel in charge of maintaining a pool or spa shall be properly trained according to standards relating to disinfectant equipment, chemical feeders and disinfectant chemicals and practices. Keep a copy of the pool school certificate on-site.

Corrective action: A reliable means of testing required ranges for pH, free available chlorine (i.e., DPD Test Kit which is unaffected by chloramines or other chlorine compounds) and total available chlorine or total bromine residuals, cyanuric acid (if used), total alkalinity and calcium hardness shall be maintained. Test methods shall be capable of measuring chemical ranges as set forth in 25 TAC Chapter 265 without dilution of pool/spa water. Provide a FAS-DPD titration test kit within 24 hours. When open, water quality tests for disinfectant level and pH at Class C & D pools and spas at Class C facilities shall be conducted at least once per day or more often if necessary to assure proper disinfectant and pH levels. If an automatic control system for disinfectant and pH is in place, disinfectant and pH levels must be measured at least once each day. Test every day.
- Fort Worth Ordinance
Weekly inspection of Pool yard enclosure and gates are not recorded. Nationally Accredited/Trained pool/spa operator certificate not prominently posted. Operational records of emergency telephone test results are not maintained. Weekly inspection of Ground Fault Circuit Interrupter not recorded.
Corrective action: Condition of Pool yard enclosure and gates shall be inspected and recorded weekly and be made available to the Director or his/her representative upon request. Provide proof of having a Nationally Accredited or Trained pool/spa operator by posting prominently their current and valid certificate. Emergency Telephone operation shall be tested and recorded monthly and be made available to the Director or his/her representative upon request. Inspection of working Ground Fault Circuit Interrupter for pool/spa equipment shall be tested and recorded at least one time per week and be made available to the Director or his/her representative upon request.

Surface overflow devices in new pools shall be designed, constructed, installed, maintained and operated to comply with all applicable provisions of the City of Fort Worth Ordinances and the State Standard.

Corrective action: Damaged or missing skimmer systems or overflow devices or parts (weirs, covers, baskets, etc.) shall be repaired or replaced. Replace damaged weir.

The name of the liquid or gas and arrows indicating direction of flow shall be permanently indicated on the pipe. Deck markings shall include slip resistant depth marker numbers and units (feet or Ft.; inches or In.; Meters or M) which are at least four inches high, a permanent and contrasting color to the background, positioned within 24 inches of the water's edge and readable when facing the water, uniformly arranged around the pool including installations at the minimum and maximum depths, at slope changes and at intermediate increments of water depth not to exceed two feet. Post 10/1/99 pool depth markers shall be spaced at distances not greater than 25 feet intervals, and with a minimum of at least one marker per pool side. Provide a 7 FT marker within 14 days. Vertical depth markings shall include sidewall depth marker numbers and units (feet or Ft.; inches or In.; Meters or M) which are at least four inches high, plainly and conspicuously posted in the top 4.5 inches of the pool wall, be permanent and contrasting color to the background, be uniformly arranged around the pool including installations at the minimum and maximum depths and at the 5-foot depth of a pool over 5 feet deep, at slope changes and at intermediate increments of water depth not to exceed two feet. Disinfectant equipment and chemical feeders shall be designed, constructed, installed, maintained and operated to comply with all applicable provisions of City of Fort Worth Ordinances and the State Standard.
Disinfection agents and other chemicals are not properly stored.
Corrective action: Disinfection agents or other chemicals and feed equipment shall be stored away from pool and spa users, off the floor in a dry, above ground level room and protected against flooding or wetting from floor, walls, and ceiling. Chlorine compounds shall not be stored in the same area as petroleum products. Provide a chemical storage area within 5 days.
- CLOSURE NOTICE
You are hereby notified that you must take immediate action to close your pool to the public until appropriate corrective actions are taken to safeguard the public from hazards detailed above in this report.
Serious health violations were identified during today's health inspection. You must close your pool immediately to the public until appropriate corrective actions are completed.
Corrective action: Before the facility named in this report can reopen for swimming pool/spa operations to the public, the owner/operator must take immediate corrective action to correct identified hazards and request a re-inspection by a Code Compliance Consumer Health Specialist. A fee of $125.00 will be required before any re-inspection may be conducted. Payment shall be made at 1800 University Dr. Room 219, Fort Worth, TX 76107 or by phone at 817-871-7255. Each re-inspection will require the fee be paid prior to the Consumer Health Specialists return. The closed pool/spa must meet minimum standards before it can be re-opened. Pool is closed until vac-alert is testing properly and all safety equipment is provided.
