Greetings!

Has anyone heard to the City of Albuquerque's Department of Public Education creating
criminal records for children with emotional disabilities?
How: Apparently when there is an emotional outburst of some kind, which is normally stated
on a child's Individual Educational Plan, the school or school officers can refer the case to the
Juvenile Justice Center or Juvenile Court?

What is happening??? Beside the end of days.. Who is in charge of these proceedings?

Please educate me.

You need to clarify your confusing allegations.

From: 8 - Discipline of Students With Disabilities / Behavior — Albuquerque Public Schools

Quote:
Referral to and Action by Law Enforcement and Judicial Authorities

Part B of IDEA and this procedural directive shall not:

Prohibit Albuquerque Public Schools from reporting a crime committed by a child with a disability to appropriate authorities; or

Prevent state and local law enforcement and judicial authorities from exercising their responsibilities with regard to the application of federal and state law to crimes committed by a child with a disability.

(34 CFR §300.535)

The above portion stems from the Code of Federal Regulations (CFR)

You might read the above reference from the Albuquerque Public Schools.
